Marketing performance can vary due to many factors outside our control (industry, seasonality, budget, competition, platform changes, offer strength, audience behavior, account history, etc.). We do not guarantee specific results such as revenue, leads, rankings, engagement, or conversions unless explicitly stated in writing.

Payments are due as stated on your invoice or agreement. Late payments may result in project delays, paused work, suspension of deliverables, or withholding of final files until the account is current. You are responsible for any third-party costs you approve (ad spend, hosting, domains, software subscriptions, printing, etc.) unless otherwise agreed in writing.

6. Refund Policy

Due to the nature of our services and time-based creative work, all sales are final once work has commenced. Refunds may be considered on a case-by-case basis only for unrendered services, at our sole discretion, and do not include time already spent, completed work, or third-party fees.

7. Intellectual Property

Unless otherwise stated in writing, all work created by Unspoken remains our intellectual property until full payment is received. After full payment, you receive a license or ownership transfer for the final, paid deliverables as described in your SOW. We retain the right to display non-confidential work in our portfolio and marketing materials unless you request otherwise in writing.

8. Third-Party Tools & Platforms

We may use third-party services to provide or support our work (for example: hosting providers, analytics tools, form providers like Formspree, advertising platforms like Meta/Google, email providers, fonts, plugins, and payment processors). We are not responsible for outages, policy enforcement, account restrictions, tracking limitations, data loss, or changes caused by third parties.

Our Privacy Policy explains how we collect and use information and how cookies or tracking may be used (including advertising pixels). By using our website, you acknowledge that cookies and tracking technologies may be used as described in our Privacy Policy and any cookie consent choices you make.

To the maximum extent permitted by law, Unspoken will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, business interruption, or platform/account issues, arising out of or related to the website or services, even if we have been advised of the possibility of such damages.

Our total liability for any claim will not exceed the amount you paid to Unspoken for the services giving rise to the claim during the three (3) months prior to the event.

We may terminate or pause services if you breach these Terms, fail to pay on time, or engage in abusive, unlawful, or unethical conduct. You may terminate services according to your SOW. Termination does not remove your obligation to pay for work completed and any approved third-party costs.

12. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the website or services after changes means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
